This is a legally binding Release and Waiver of Liability (“Release”) executed by you (“Participant”) for the benefit of Refreshed Retreats (“Company”) is conducting a retreat and Participant wishes to voluntarily partake in the retreat, classes, trainings or programs on May 18-21, 2023 (hereinafter referred to as the “Retreat”).
I certify that I have not been advised to not participate in any activities of the Retreat by a qualified medical professional. In addition, I certify that there are no health-related reasons or problems which would preclude my participation at the Retreat.
In consideration of me being permitted to participate in the Retreat, I do hereby release, waive, forever discharge, and covenant not to sue Company, its owners, directors, subsidiaries officers, agents, employees, staff, volunteers (collectively the “Releasees”), from and against any and all liability for any harm, injury, damage, claims, demands, actions, causes of actions, costs, and expenses of any nature arising out of or related to any loss, damage, or injury, including but not limited to suffering and death, that may be sustained by myself or by my property, during my participation at the Retreat or in transit to or from the Retreat.
I have agreed to this Release in full recognition and appreciation of the dangers, hazards, and risks or such activities, which dangers include but are not limited to heat stress, heat exhaustion, heat stroke, dizziness, muscle sprains, muscle strain, broken limbs, teeth etc., and which could include serious or even mortal injuries or property damage. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and lack of hydration. I further attest I fully understand the aforementioned risks and hazards and agree that I assume the risks involved with my participation at the Retreat.
I agree to save and hold harmless, indemnify, and defend Company and Releasees from any claim by myself or my family, arising out of my participation at Company.
I consent and agree that Company and/or their coaches, agents, employees, representatives or volunteers may take photographs or digital recordings of me during any activity during the Retreat no matter what facility or location and use these in any and all media for training or promotional purposes including but not limited to digital, brochures, print, videos and social media. I further consent that my identity may be revealed therein or by description text or commentary. I waive any rights, claims or interest and I understand that there will be no financial or other remuneration.
The waiver, release of liability and image release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
In signing this Release, I acknowledge and represent that they have read and fully understand this Release before signing it and are signing this Release on their own free will.
